Author Topic: Bad Experience with Joseph Souza (real estate agent) + I'm looking to buy an apt  (Read 2962 times)

Hi everyone,

I thought I should let people know about my experience with Joseph Souza. I gave an offer to an apartment in Jackson Heights for which he was the seller's agent. The seller accepted the offer and, once that happen, he took the longest time to give us the contract -- which meant he could still show the apartment around. After over 2 weeks of him disappearing and coming up with excuses, he told my agent that he would give me all the documentation in 3 days. 2 days later, he calls saying that he sold the apartment to somebody else, contract signed and everything. I had no opportunity to give a counter-offer, no forewarning, nothing.

Unfortunately, as there was no contract signed, there is nothing I can do to fix my situation -- I'm back to where I started with looking for apartments, since he was holding me up for a month, as is my real estate agent who is obviously not getting any compensation for all her work. But I think it's important for other real estate agents out there to know that this guy might do this to them.

In the meantime, if anybody is selling a one-bedroom apartment in good shape, with a nice view, on which the board allows subletting, and is near the Roosevelt ave station, I am game.

I think this is pretty standard procedure for agents, he probably didn't want to split the commission with your agent so was stalling for a bit to see if he could find a buyer on his own. Can't say for sure, but that's what it sounds like to me, sorry to hear

Hello Sabrina,

Sorry to hear about your experience. I'm a real estate broker as well and was involved in a similar situation last year with some clients of mine. To make matters worse, the were giving birth to their first child about a month after they were hoping to close. Both the seller and the seller's agent dragged their feet for weeks, and my clients paid about $2500 in lawyer fees before we were told that the seller already had another contract signed the whole time.

It was quite awful and completely unethical and immoral.

However, things always turn out for the best, and I ended up finding my clients an even better apartment.

It sounds like you have an agent who works well for you, which is a good thing. Keep looking and I'm sure you'll find the right place.
