Parking ticket while waiting in car
« on: December 08, 2010, 11:59:51 PM »
Is it possible to receive a ticket for double parking while waiting in your car? Didn't think it was possible but it happened to me. Wonder what my chances are of getting it dismissed. Any info would be greatly appreciated.

I don't know about getting it dismissed but you can probably get the fine reduced, usually to half the amount.

Write a letter -- it doesn't matter what it says, they process it automatically and send you a reduced fine. Then you can either pay that or have it reviewed by an administrative judge.

Do try not to double-park though. It's a huge problem in the neighborhood especially since people here block traffic and honk like crazy.

Good luck!

Were you in the passenger seat, or were you driving? Were your hazard lights on?

In NYC double parking is prohibited at all times if you are operating a passenger vehicle.  Commercial vehicles have some leeway when making deliveries.  That being said double parking is like jay walking it is rarely enforced.  Most of the time a police vehicle will come up behind you and announce over their speaker to move your vehicle and will only ticket you if you don't comply.

It's ok to double park just as long as you are in the drivers seat. It's not ok
to leave your car unattended while double parked. Most of the times the cops
wont even bother you if they see you behind the wheel.

One bad experience I had was in Forest Hills, I was double parked near the corner
waiting for a Postal Service truck to pull out, this was on a quiet one way residential street.

Anyway this police car slows down and over the loudspeaker tells me to move which I did,
so I drive around the block to see if the Postal Service truck had pulled out and I double
park in the same spot with the engine running(I was doing a moving job and that spot
was in front of my customers building)

Anyway I look in my outside drivers side mirror and see the cop car, so I drive off and
as soon as I make the right turn I see the flashing lights of the police car.....I take out
my drivers license/registration/insurance card, before I can speak, she starts writing
a parking ticket and doesn't let me say anything. You can see in her face the stress though
she is being pressured by her bosses to meet ticket quotas. It was something like $125.00.

I didn't think she was going to come back after I circled the block. I guess the police don't
have any better things to do. Fine, give me a ticket if I had left the vehicle unattended
but I was just waiting for the postal guy to come out and move his truck. I wasn't blocking
traffic, besides the street was quiet. Hands down Bloomberg is the most hated mayor of NYC
EVER!

From the NYC DOT Website under the frequently asked questions link.  "Double parking of passenger vehicles is illegal at all times, including Alternate Side Parking Regulation days, regardless of location, purpose or duration."

Was the postal truck leaving anytime soon?  Did you signal that you're parking into that spot instead of double parking?  I've seen a police car block and ticket 2 cars with drivers who were parked at a corner fire hydrant on 37th Ave.  One car tried to back up and leave, but the cop wouldn't let him saying,"..if you keep backing up, we're gonna have a problem."

Another thing is the anti idling laws.  5 minutes max with some exceptions unless it's a school area where the limit is one minute.   :o

I asked a police officer friend of mine and he said it depends on the officer, if he wants to be a b@llbuster, he'll give you the ticket regardless. Most of the time they just wave you along. The cop who ticketed me just creeped up behind me and when I tried to drive away he put his lights on and said "it was too late, I should have seen him approaching in the mirror".

Cops...they are people just like You and me (well, maybe not me... :D)

My godfather was a 1st grade detective...he hates cops...LOL.  I don't like the system it is working under, but I understand why.  The department needs training for most of these officers and there is no money.  Many of these fellows have a predisposition and irrelevant prejudices...living in a world of their own.  I know plenty of cops that are as cool and as real as they come.  I also have seen those that think the badge defines them as an individual...saddest fellows you will see.  I think that in the next decade we will see a better trained, More educated and less insecure bunch of young men and women that will make us proud.
Time is running out!

I thought that the people who give out parking tickets are not police officers, but just minimally qualified people hired to issue parking tickets; they wouldn't have any actual authority in a police situation.  Believing this, I've hated the meter maids but not the police officers, but if this is the case... hmmm...
