Questions Re Co-Op Rules

I'm relatively new to co-op ownership & had a couple of questions.  I bought a co-op that had rules prohibiting, e.g., subletting & dogs.  I agreed to those rules, and in fact, wanted/agreed with them.  However, at times its seems like there are more renters & dogs in the building than not.

Question 1:  Who do I address concerns about (possible) violations of these rules?  The co-op board &/or the management agency?

I read somewhere that owners of sponsor units are allowed to sublet regardless of a rule prohibiting it.  If this is true:

Question 2:  Do the renters in sponsor units have to comply with the co-op rules (i.e., can they have dogs)?

Hi,

Speak with your attorney who was involved in the transaction.  Your attorney received a complete resale package from the seller's attorney pertaining to the information that you are inquiring about.

The question is who is on the board. Could the sponser have a large number or majority on the board? If they are a large number I would think about talking to management. In my coop, we do not have a sponser, we can contact either. I do not know of any ruling that means you could ignore the house rules. So, if the rules say no subletting or no dogs, then they should appy.

Perhaps, a little homework before contact anyone. Do you have a friendly neighbor would would be able to advise you?

i am sure it varies from building to building, but i bought a sponsor unit in my building in 2002. the only advantage i got was not having to pass the co-op board screening process (which i am pretty certain i'd have been able to pass anyway).

I just moved out of a co-op in JH and part of the reason I wanted to get out was that the owners who'd sublet their units to tenants did not seem to care about enforcing the house rules - unfortunately, the owner of the most units was also on the board. The board did nothing and neither did the management company. The whole thing ruined me for living in an apartment ever again.

It would seem to be a conflict of interest to own various units in a co-op and to as well serve on the board.  This would seem to be an interesting question when purchasing a unit.  It would as well seem to be a conflict of interest to have the building manager own units.

When purchasing a Co-op you should always consider the number of unsold/rental units and sponsor units.

When we bought, we did not know the right questions to ask, but some of them would not have been answered honestly had we known...
