So you saved 12 dollars considering traveling time and cost its not worth it.

Well, twenty-two really. But even if you take out ten dollars for my trouble, it still seems a decent deal considering I was walking past there anyway.

But now that you've brought this up, I'm feeling rather depressed about my decision. I mean I started off feeling happy, and now...

Maybe it isn't really worth it?

No, you should feel good about it. Btw, there is a way to fight tickets via mail, which is what my bf has been doing -- no time wasted going there etc. Just write a letter challenging the ticket, and they will respond.

You did good!

parking ticket for no reason
« Reply #62 on: January 05, 2010, 11:57:09 PM »
I can't be the only one in the neighborhood who has gotten a parking ticket for no reason. I'm talking about a legitimately parked car flanked head and toe by other legitimately parked cars, no hydrant on that side of the block, nearest curb-cut about 8 cars away, no construction or movie signs, given a "no parking" ticket at 2 in the morning. Has something like this happened to anyone else?

Check to make sure it's your license plate number on the ticket.  Could be someone else's ticket that the recipient placed on your windshield.  Also, isn't there some sort of space for a code on the ticket where they have to give you the reason, like street cleaning or parked too close to an intersection?  Does your ticket have a code written in that you could look up?

I don't know if this will help you, but I found the codes listed here.

You sure it's for parking? They love to get you for expired registration and inspections.

This has happened to me several times -- for an expired meter when the car wasn't even parked on a meter and for lack of inspection sticker when the car had an inspection sticker. My sense is that traffic agents in the neighborhood throw shit at us to see what sticks. This is obviously a problem because the system relies on transparency, and even more so because the burden of proof is on us. I complained to 311, the efforts undertaken, as you can gauge yourself, were significantly smaller than the zeal with which they issue tickets.

Anyway, here's what we did: we wrote a letter contesting the ticket, we received an automatic response asking us to pay half of the fine (ridiculous in the case of the non-missing inspection sticker, as you can imagine, suggesting that no one really reads the letters). We chose to fight further, we paid the fine, then the case went to a traffic judge panel. We won and we got a refund check back. Best of all, all was done through mail.

Good luck!

Thanks for the code list. The ticket does have my car's particulars, so it is for my car. It's a simple $60 fine for parking in a "no parking" area, even though--as I was able to take in a picture--the car is clearly one one car length away from a double-arrowed "no parking Wed 9:30-11:00" sign, and there's no hydrant in sight, nor is it a bus street. There is a no-parking curb cut with signs, but that is about 6 cars lengths (and so, about 6 cars) in front of where mine was. Registration and inspection stickers all up-to-date.

Now that I think about it, I wonder if the "no parking" sign up the block has both parts to it. I'll have to go back and see. That actually happened to me before on the other side of Travers Park. I took pictures, gave them to the woman parked in front of me, and we both got the fines waived, but not until we went to traffic court. The judge didn't even look at the pictures. She just looked at the address, muttered something about Jackson Heights, and dismissed the ticket. But I shouldn't have to go to traffic court for an illegitimate ticket. So this time I called the Civilian Complaint Review Board and filed a complaint against the officer who gave me the ticket.

Did you have any success with that? Do you know if any actions were taken? I never heard from them after I complained.

I recently renewed my car registration online a few days before the end of the month when it was due for renewal.  Although my car was legally registered at all times, I had to leave the expired registration sticker on my car until the new one arrived in the mail a week later.  Needless to say, they ticketed me each day for the "Reg. Sticker Expired" reason with a $65.00 fine per ticket (despite the note I put on the car explaining and giving the confirmation # for the payment).

I have no intention of paying any of these fines and hope that I can successfully fight this online (or should I attempt by mail?).  I know it SHOULD be as simple as someone being able to look up DMV records, see that my car was, in fact, legally registered at all times and that should be the end of it.  But this is NYC and things never work in the "common sense" way.  Does anyone have any advice on what I should provide?  I was thinking proof of payment, and maybe a copy of my new registration card and the email I received from DMV online saying that my sticker would come in the mail in 1-2 weeks.  If I try to dispute this online, would they be able to look up my DMV records to verify my registration?  Has anyone successfully disputed this kind of thing online when they haven't done anything illegal?  I just started a new job and really don't want to take off anytime soon so that I can make the 830-4pm DMV hours.

On Line rules  :police:  I have  used the on line forum and have won!  Scan your materials showing you paid before the deadline, your correspondence with NYSDOT and even the note you had placed in the windshield---all that should be sufficient for a dismissal.
Congratulations on your new job----in this economy that's like winning lotto!!

I disputed this online, and this is the result for all 3 tickets ($65 each * 3 = $195.00):

The respondent has been charged with violating Traffic Rule 4-08(j)(3) by standing or parking a vehicle bearing New York plate or plates that did not display a current registration sticker. Respondent claims that the summons should be dismissed, because their vehicle was properly registered at the time of summons issuance but admits that the appropriate sticker was not affixed to the vehicle. The New York City Traffic Rules require that only a valid NYS sticker be affixed to the windshield of the vehicle. Respondent's claim is rejected because a valid NYS registration sticker was not properly affixed to the windshield of respondent's vehicle on the day and time of the violation.

I AM SO STEAMING MAD RIGHT NOW!!!!!!!!!!!!!!!!!!!!! Does anyone know if I can fight this?

It's not fair, but if you do everything in person, you could still pay the registration and get the sticker and then not put the sticker up on time and so get fined. It's similar to getting into trouble if you don't have your license with you if you get stopped, or your insurance card. The difference here is that you didn't even have the sticker to put on. I don't know if you can appeal, but check the fine print of the website where you registered the car. Was there any warning that if you waited until the end of your sticker month, then you might not get the sticker in time? If not, you might have something on which to base an appeal.

By the way, after going to court three times-- being sent back twice for further photos, then video-- and having the third judge agree that I successfully argued my case, he made me pay the fine anyway based on his (questionable) interpretation of a sign rule. So I went to Danny Dromm's office, where I was the second person with this issue. Not surprising-- it would have been a row of cars wrongfully ticketed. Then I mailed all my evidence (along with the required check) to the appeals office. Finally, the ruling and the ticket were overturned, and I got my money back. But the effort involved and the amount of time spent (and metrocard money) was ridiculous.
